High Court declares lockdown regulations invalid

CAPE TOWN - The Gauteng High Court has declared the previously promulgated level 3 & 4 lockdown regulations under the Disaster Management Act invalid and unconstitutional.

The court action was brought against Co-operative Governance and Traditional Affairs Minister Nkosazana Dlamini-Zuma by lobby group Liberty Fighters Network.

The group claimed that the regulations infringed on the rights of citizens and were unconstitutional.

According to court papers the declaration of invalidity will however be suspended until Dlamini-Zuma consults with "relevant ministers to review, amend and republish the regulations"

The court directed Dlamini-Zuma to revisit the regulations with "due consideration to the limitation each regulation has on the rights guaranteed in the bill of rights contained in the constitution.

Dlamini-Zuma will have 14 days to comply with the order that she consult and amend regulations.

In the meanwhile, the regulations promulgated as lockdown level 3 will still apply.

The declaration excluded the regulations pertaining to the sale of tobacco and related products.
